Important Copyright Ruling Affecting Documentary Film Producers Analyzed

[] Agoura Hills, CA - Up until last week, the Digital Millennium Copyright Act (DMCA) of 1998 had a strangle-hold on Fair Use by documentary and other filmmakers, but this changed when a team of University of Southern California (USC) Law students from the Intellectual Property and Technology Clinic ("the Clinic") under the supervision of Jack Lerner, professor at USC and Director of the Clinic, together with Michael C. Donaldson, an entertainment attorney who represented a coalition of filmmakers and organizations such as Kartemquin Films, the IDA, and other filmmaking groups, appealed to the United States Copyright Office and won an exemption for filmmakers. This court ruling has a direct and immediate impact on everyone producing videos today.

On Thursday, August 5th, 6:00pm (PDT), the Digital Production BuZZ, the world's only interactive talk radio show for digital production, post-production and distribution, will feature Jack Lerner whose team was responsible for obtaining the recent court ruling.

Later in the program, Jonathan Handel, Of Counsel at Troy/Gould, and Bruce Nazarian, President of IDMA, two regular contributors to The BuZZ, will provide additional legal and industry perspective on the impact of this ruling.

The DMCA made breaking the digital locks on DVDs and other media a criminal act. As it says in the July 26, 2010 article, "USC Intellectual Property & Technology Law Clinic Wins Copyright Exemption for Filmmakers," the team of USC Law students "helped secure an exemption that will allow documentary filmmakers to use material contained on DVDs and other sources that were previously off limits."

Lerner, Handel and Nazarian will conduct an in-depth, no doubt lively, examination of how the new exemption will impact documentary filmmakers and their work.
